Australian consumers have rights under Australian Consumer Law when buying goods. These rights are called consumer guarantees. They apply in addition to any supplier or manufacturer warranty that may come with a product.

Nothing on the HoteMax website, in our policies or in product information is intended to exclude, restrict or modify rights that cannot be excluded under Australian Consumer Law.

What Consumer Guarantees May Cover

Consumer guarantees may require products to:

  • Be of acceptable quality
  • Be fit for their usual purpose
  • Match the description shown before purchase
  • Match any sample or demonstration model where relevant
  • Be safe, durable and free from unacceptable defects
  • Come with clear title and undisturbed possession where applicable
  • Meet any specific purpose made known to HoteMax where applicable

The exact rights and remedy can depend on the product, price, product type, circumstances of purchase and nature of the problem.

Major Problems

A product may have a major problem where, for example, a reasonable customer would not have bought it if they had known about the issue, it is substantially unfit for its normal purpose, it is unsafe, it is significantly different from the description or it cannot be fixed within a reasonable time.

Where a major problem is confirmed, customers may have rights to choose between a refund or replacement, depending on the circumstances and applicable law.

Minor Problems

If a problem is minor and can be fixed within a reasonable time, HoteMax may be able to arrange a repair, replacement, refund or another suitable remedy.

Proof And Assessment

HoteMax may request reasonable information to assess a consumer guarantee request. This can include order details, product photos, videos, troubleshooting steps, serial numbers, packaging photos or the product itself for inspection.

When A Remedy May Not Apply

Consumer guarantee remedies may not apply where the issue is caused by misuse, accidental damage, unauthorised modification, failure to follow instructions, abnormal use, normal wear and tear, incorrect installation, external damage, compatibility issues not caused by the product, or where the customer simply changes their mind.

Warranties Are Additional

Some products may include a supplier or manufacturer warranty. A warranty may provide additional support, but it does not replace consumer guarantees under Australian Consumer Law.

Online Product Information

HoteMax aims to provide accurate product titles, images, descriptions, pricing and availability. Customers should review product details carefully before purchase and contact us before ordering if compatibility, size, colour, power requirements or accessory inclusions are important.

How To Make A Claim

Contact the Contact page form with:

  • Your order number
  • Product name
  • Description of the issue
  • Photos or videos showing the issue
  • Any troubleshooting already completed
